1. Acceptance of Terms
By accessing or using Kitonga's WiFi hotspot management platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.
2. Description of Service
Kitonga provides a cloud-based platform for managing WiFi hotspots, including MikroTik router integration, mobile money payment processing, voucher generation, user management, and analytics.
3. Account Registration
To use our Service, you must:
- Be at least 18 years old or have legal capacity to enter contracts
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4. Subscription and Payment
- Subscription fees are billed monthly or annually as selected
- Payments are processed via M-Pesa, Tigo Pesa, Airtel Money, or bank transfer
- Subscriptions auto-renew unless cancelled before the renewal date
- No refunds for partial months or unused features
- We may change pricing with 30 days advance notice
5. Acceptable Use
You agree NOT to:
- Use the Service for illegal activities
- Distribute malware or harmful content through your hotspot
- Attempt to access other users' accounts or data
- Resell the Service without authorization
- Overload or disrupt our infrastructure
- Violate any applicable laws or regulations
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring your WiFi users are informed about data collection on your hotspot.
7. Intellectual Property
The Service, including all software, designs, and content, is owned by Kitonga and protected by intellectual property laws. You may not copy, modify, or distribute our software without permission.
8. Limitation of Liability
To the maximum extent permitted by law, Kitonga shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption.
9. Termination
We may suspend or terminate your account for violation of these terms. You may cancel your subscription at any time through your dashboard. Upon termination, your data will be retained for 30 days before deletion.
10. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify you of significant changes via email.
11. Governing Law
These terms are governed by the laws of the United Republic of Tanzania. Any disputes shall be resolved in the courts of Dar es Salaam.
